WHAT IS THIS
These are the terms and conditions on which we supply products to you, whether these are goods, services or digital content.
WHY SHOULD YOU READ THIS
Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms or that they require any changes, please contact us on the email address provided.
Bohus Partners Limited (12862955) (we and us) is a company registered in England and our registered office is 11 Sanders Drive, Moulton, Northampton, NN3 7BY. We own and operate under the trading name of Bohus Scooters and own the website https://www.bohus.co.uk
Any queries should be directed to us via email (firstname.lastname@example.org) or via our contact form found on the contact page. If we need to contact you, we shall do so by telephone or in writing to you at the email address provided to us in your order. When we use the words "writing" or "written" in these terms, this includes emails.
OUR CONTRACT WITH YOU
Our acceptance of your order will take place when we email you with an automated acceptance message and order number. At which point a sales contract will come into existence between you and us. If we are unable to accept your order, we will inform you of this in writing and refund any charges that could have been taken in full inline with our refunds policy section. This could be due to various reasons including but not limited to; unavailability of stock, unexpected limits on our resources which we could not reasonably plan for, we have identified an error in the price or description of the product, or because we are unable to meet a delivery deadline you have specified.
We will assign an order number to you at time of purchase and an automated email will be sent containing this and other relevant information. This order number will be needed to register for our warranty and will be required when contacting us regarding your order.
Images of the products on our website are stock images and to be used for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images.
In addition the packaging of any product may vary from that shown in the images on our website due to factors outside of our control and determined at the manufacturing stage.
We are an online only retailer - there is no option to collect goods from us, even at the registered company address. The costs of delivery will be as displayed to you on our website for each product. Delivery is based on the value of your order - in some cases we offer combined shipping if appropriate or available to us.
We endeavor to ship all products as soon as possible and will confirm via the online store when an order has been fulfilled. If the delivery date is not specified during the order process, we will deliver the product(s) to you as soon as reasonably possible and in any event within 30 days after the day on which we accept your order.
If our supply of the product(s) is delayed by an event outside of our control, then we will contact you as soon as possible to let you know and we will take steps to minimize the effect of the delay. We will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.
If no one is available at your address to take delivery, our courier will leave you a note informing you of how to rearrange delivery. Our courier will then make a second attempt to deliver the product. If you are not available to accept the second delivery attempt, the product will be returned to a local depot and our courier will leave a note informing you how to arrange collection.
If after a failed delivery to you, you do not re-arrange delivery or collect them from a delivery depot we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract between us and you. If we end the contract in the situations set out above we will refund any money you have paid in advance for products we have not provided, but we may deduct or charge you reasonable compensation for the net costs we will incur as a result of you breaking the contract.
On confirmed delivery from the courier you become responsible for the goods. The goods will be your responsibility from the time we deliver the products to the address you gave us or directly to you. Any claims for damaged goods during transit must be registered with the courier at the point of delivery so we can work with the courier to resolve. Once the goods are accepted by you, and have become your responsibility no claims will be processed for damaged goods in transit.
CANCELATIONS AND RETURNS
Your rights when you end the contract will depend on what you have bought, whether there is anything wrong with it, how we are performing and when you decide to end the contract.
If you wish to cancel an order made with us then you must contact us to cancel before the item has been fulfilled. At this point you will be entitled to a full refund. Cancellations and refunds after an item has been fulfilled will be subject to shipping charges deductions.
If what you have bought is faulty or misdescribed you must contact us within 14 days of ordering to discuss resolution. Faulty goods reported inside 14 days of receipt will be replaced or repaired. Faulty goods reported after 14 days since purchase will be processed under the terms of a warranty claim provided they have been registered and operated inline with the manufacturer guidelines as outlined in our warranty terms and conditions.
Faulty goods or warranty claims will be assessed to ensure the product has not been misused. This decision remains the sole responsibility of Bohus Partners.
If you have changed your mind about the product it must be reported to us with your order number within 14 days. You will be entitled to a full refund provided the item is unused, but this will be subject to deductions as outlined below. Items must be returned in their original retail condition and packaging. If items are not returned to us in unused original condition then deductions will be made to the refund.
You have a legal right to change your mind within 14 days and receive a refund. These rights are outlined under the Consumer Contracts Regulations 2013. In all cases, if you are exercising your right to change your mind you must send off the goods (or allow us to collect them) within 14 days of telling us you wish to end the contract.
We will pay the costs of return or, in the case of scooters, collection:
If the products are faulty or misdescribed.
An error in pricing or description.
If the product is registered as damaged upon delivery.
In all other circumstances, (including where you are exercising your right to change your mind) you must pay the costs of return or collection. Please note that this includes the cost of providing suitable secure packaging.
We will refund you the price you paid for the products via the method you used for payment within 14 days of receiving the goods back into stock. However, we may make deductions from the price, as described below.
We may reduce your refund of the purchase price to reflect any reduction in the value of the goods if the product has been used. If damages have been caused by your handling or using the item in ways not outlined in the manufacturers guide. In addition riding a scooter outdoors or returning the product to us heavily soiled, scratched or dented.
OUR RIGHT TO END A CONTRACT
We may end the contract if you break it and we may end the contract for a product at any time by writing to you if
You do not provide us with information that is necessary for us to provide the products.
You do not, within a reasonable time, allow us to deliver the products to you.
You place an order with us for delivery outside the United Kingdom.
Our payment provider identifies suspected fraud or suspicious activity.
If we end the contract in these situations we will refund any money you have paid in advance for products we have not provided, but we may deduct or charge you reasonable compensation for the net costs we will incur as a result of you breaking the contract.

We are under a legal duty to supply products that are of satisfactory quality and are in conformity with this contract. Nothing in these terms will affect your legal rights.
PRICE AND PAYMENT
The price of the product will be the price indicated on the order pages when you placed your order. We use our best efforts to ensure that the price of the product advised to you is correct. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before fulfilling your order and we have the right to cancel your order when pricing discrepancies are identified. If we accept and process your order where a pricing error is obvious and unmistakable and could reasonably have been recognized by you as a mispricing, we may end the contract, refund you any sums you have paid.
We accept payment with, Mastercard, Visa, Maestro, Paypal, and Laybuy. You must pay for the products before we dispatch them.
We only supply the products on this site for domestic and private use. If you use the products for any commercial, business or resale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of you breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

This section informs you of our policies regarding the collection, use and disclosure of Personal Information we receive from users of the site. We use your Personal Information only for purposes of providing services via this site. By using the site, you agree to the collection and use of information in accordance with this policy.
INFORMATION COLLECTION AND USE
While using our site, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to your name, address, phone number and email address.

While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security. Customers will be informed of any breaches of corporate systems within the guidelines of public law.
